Happy Belly Bakes, a Bengaluru-based homegrown baker, emerged victorious last month after a four-year legal battle against e-commerce giant Amazon in a trademark infringement lawsuit on August 30, said Ms Hinduja.Happy Belly Bakes, a women-run business with about 30 employees, had launched a successful venture into perishable private-label foods in 2017 and has since adopted the name Happy Belly.Ms Hinduja filed a lawsuit against Amazon Seller Services, Cloudtail India, and Tootsie LLC after discovering the deceptively similar name.According to the research, Amazon claimed that its Happy Belly Bakes business was different from that of Ms Hinduja's, and that Cloudtail and Tootsie were also using the Happy Belly brand name for their goods worldwide.

However, the court dismissed the charge and said the bakery has been operating since 2008, and that the defendant's excuse for using the plaintiffs' trademark is infringing and passing off, the court said, by design.Amazon was also required to remove the goods from its website in India, according to Ms Hinduja.
