Delhi HC appoints a counsellor for the child and orders a report to be filed following counselling.

Delhi High Court appointed a child counsellor for master Sameer Gupta on Wednesday . Delhi High Court ordered that he would accompany his 3-year-old son to a conciliation center for the said purpose today at 3 PM and on all other dates as determined by the child counsellor .

New Delhi, India, November 30 : In Delhi High Court, a Ukrainian woman filed a Habeas Corpus petition claiming that her 3-year-old son had been imported to India by her ex-husband, who is the father of the child.After guiding the child, the Delhi High Court appointed a child counsellor for master Sameer Gupta on Wednesday and asked him to make a report.Swati Shah was appointed child counsellor by a division bench composed of justices Sidharth Mridul and Talwant Singh.After consulting master Sameer Gupta, the bench directed the child counsellor to speak with the child in the High Court's conciliation and mediation center today at 3 PM.

According to the bench, we must make sure that master Sameer Gupta has received appropriate and professional advice in order to cope effectively with the congenial environment and trauma he has experienced.The bench recommended that the child counsellor, Swati Shah, be notified of this request on or before the next date of hearing.The court ordered that you renotify on the following Friday.Shah, we provided you with as many opportunities as possible to counsel the child.The child has been away for eight months.

Advocate Sravan Kumar said that the court should consider extending the duration of contact with the mother.The Court said, we would consider it.The mother was also asked to show the mother a Ukrainian cartoon to Master Sameer, who he used to see.The bench pushed up the counsel and said, You are missing the woods for the trees.The petitioner was asked to play some recordings of the songs again by the judge, who said that the court should disregard the official from the Ukrainian government's hearing.The court denied that anyone from the Ukrainian government should attend the hearing.

Lydia, the petitioner's interpreter, said she is from Ukraine to take the child back at the hearing.He was brought here unauthorisedly by the respondent.She said, Please understand her feelings as a mother.For the sake of the child's safety, she would never take the child to the hospital.The bench agreed that the child's welfare is most important in this court.This court is not concerned with personal relationships between the two parties.Our goal is to ensure the child's safety.

You'll get the opportunity, but this is not the time right now.Once we have a report, we'll investigate where Sameers' welfare is concerned, the bench said.The petitioner's counsel said that the father appeared during the initial hearing, but later he did not.According to the court, there is a way to do so.

The Ministry of Home Affairs, Ministry of External Affairs, and Delhi police were alerted on a habeas corpus petition brought by a Ukrainian woman to locate her 3-year-old son.The petitioner told the bench that she was a divorcee and that a Ukrainian Court granted her son's custody in 2021.The man took their son away without advising her on the basis of fabricated reports.
