Chennai: On a prima facie basis, the Madras High Court has decided that a woman is entitled to maternity leave and other financial benefits for her third child, the first after joining government service; therefore, this Court is of the considered position that considering the petitioner's entry into public service on September 27, 2021, the government would not be prejudiced if the applicant entered public service after the birth of two children and sought maternity leave for the first time after she had secured public service, says She had asked the respondent to extend her maternity leave for a year when she was expecting her third child.Although the government allows a woman to request maternity leave even if she has three children, she is able to do so only after the birth of two children.She petitioned the Supreme Court, claiming that her argument was rejected.The government advocate obtained a copy of the Human Resources Management (FR-III) department's August 2021 GO, which stated that no maternity leave can be granted for the third child enrolled in the scheme.
