PANAJI: Vijay Karbotkar has been sentenced to life in prison and was fined Rs one lakh for the murder of Lavu Parsekar in 2013 at Porvorim.Shailesh Naik, the first suspect in the lawsuit, was cleared by Section 302 for murder, which was committed in violation of Article 34 of the Indian Penal Code (IPC), but was found guilty under Section 323 for deliberately causing bodily harm in the year 2018.The prosecution has substantiated Vijay Karbotkar's complicity in the death of Lavu by taking into account the testimony of the witnesses, as well as the medical evidence and the surrounding circumstances (that the deceased was stabbed on the vital areas of his body, namely, abdomen, and that there was not just one attack caused by stabbing but also around four other stab wounds), according to additional sessions judge Mapusa, Sherin Paul.A Talaulikar, a public prosecutor, sought the maximum term and assembled a list of criminal cases against the accused that are either being investigated or pending.

Following a lower court's decision in August 2015 to place charges against both the perpetrators for a culpable murder not equal to murder (Section 304 II), the state was allowed to challenge it by way of a revision petition.The Supreme Court referred to murder charges under Section 302 as opposed to Section 34 against both the accused.
