SC upholds Calcutta HC ruling on CBI investigation into source of application in teaching recruitment scam

Supreme Court overturned Calcutta High Court order on Friday . The CBI ordered to conduct an investigation into the source of an appeal in connection with alleged negligence in the West Bengal Central School Service Commissions order dated 23 November 2022 and the Order of the Division Bench (Calcutta HC) dated 24 November 2022 .

New Delhi, India, November 25, : The Supreme Court overturned the Calcutta High Court order on Friday, instructing the CBI to start an investigation into the source of an appeal in connection with alleged negligence in the West Bengal Central School Service Commission's order dated 23 November 2022 and the Order of the Division Bench (Calcutta HC) dated 24 November 2022, the court said.According to the court, the CBI's request to investigate at whose behest the interim application was submitted to the Single Judge should therefore be postponed.The Court said on November 23, a single-judge Calcutta High Court judge found that the Commission's report is a benami complaint, prima facie.The Single Judge enquired into the counsel's character to see if he had written the petition.

The CBI was ordered to conduct an investigation into the source of the application, and the main secretary to the West Bengal government was summoned to appear personally on November 24 to address some of the concerns raised by the single judge's orders, which were later rejected by the Calcutta HC division bench, which dismissed the appeals.
