Supreme Court of Gauhati appoints a new investigating officer in a theft case

Gauhati High Court orders change of investigating officer of theft investigation . Biju Kathar was convicted to be the mastermind in a theft lawsuit .

GUWAHATI (GUWAHATI): After the accused said the new IO was acting out of personal vendetta against him as a result of a dispute between them over a tribal property, the Gauhati High Court has directed the Commissioner of Police, Guwahati, to change the investigating officer (IO) of a theft investigation.On hearing a pre-arrest bail petition filed by Biju Kathar, who was convicted to be the mastermind in a theft lawsuit, a single bench of Justice Parthivjyoti Saikia stated that the charge brought by the petitioner is a serious one.In the Guwahatis Hatigaon district, two motorcycles were stolen in December.Kathar was convicted of being the mastermind of the theft investigation, according to police.

The petitioner also stated that police have unnecessarily harassed him because of his own personal concern.The petitioner has posed a copy of a petition before the court requesting that Saikias be prosecuted in the case by a group of people jointly filed before the circle officer at Sonapur revenue circle.The bench accepted petitioners' counsel, R Baruah, who argued before the court that the IO of the case was unnecessarily and illegally using his official authority to threaten an innocent person.The court granted pre-arrest bail to the petitioner cum accused, subject to a Rs 25,000 bond, while acknowledging the alleged IO charges.

When a new investigating officer is appointed, only the petitioner may appear before him.According to the order, the new investigating officer shall have the right to petition this court for the cancellation of the petitioner's bail in the most suitable circumstances.
