The Supreme Court grants the woman more time in the alleged rape case involving a BJP leader.

New Delhi: The Supreme Court gave a woman who has filed a rape charge against BJP leader and former union minister Shahnawaz Hussain a week to bring on record certain material documents.According to the counsel for the complainant woman, some material facts related to the alleged offence have been obscured by the BJP leader's counsel, and he wanted to include it on the top courts record.The matter will be listed for trial on October 12, according to senior attorneys Mukul Rohatgi and Siddharth Luthra, who was appearing for the woman.The bench announced on September 19 that the top court had postponed the hearing on Shahnawaz Hussain's appeal against a Delhi High Court order related to an FIR brought against him regarding a rape lawsuit filed by the woman.The Supreme Court, on August 22, suspended the operation of the high court order, saying the 2018 order did not contain perversity, and had then vacated its earlier interim order suspending the operation.The top court had then stated that the effect and function of the order under scrutiny was to be considered pending further scrutiny.Shahnawaz Hussain denied the allegations in his order.

The provisional orders have been vacated.The FIR should be registered as soon as possible.The investigations will be concluded and a detailed report under Section 173 CrPC will be submitted to the learned MM (metropolitan magistrate) within three months.The high court has also argued that although a reference is made to the transcript of the prosecutrix's statement on four occasions, there is no reason why the FIR was not filed.

The police will only determine whether or not an offence was committed and by whom, when they find out.According to the high court, there seems to be a total refusal on the part of the police to even file an FIR in the present situation.
